This Policy is subject to and made a part of the Valid Record Terms and Conditions of Use (“Terms”), which are incorporated into this Policy by reference.
This policy describes the types of information we may collect from you or that you may provide when you visit the website https://validrecord.com (our “Website“) and our practices for collecting, using, maintaining, protecting and disclosing that information.
The Website is owned and operated by Valid Record, LLC (“Valid Record”, “we”, “us”, or “our”). Valid Record is committed to protecting the privacy of our visitors’ (“visitors” or “you”) personally identifiable information (“Personal Info”, “Personal Information”, “Personal Data”, or “PII”). We provide this Privacy Policy in order to explain our online information practices and the choices you can make about the way your information is used by us. This Privacy Policy describes how we collect, receive, use, store, share, transfer, and process your Personal Information, as well as your rights in determining what we do with the information that we collect or hold about you. You agree to this Privacy Policy, in its entirety, when you access or use our Website.
The Sites are intended for adult use only, and we do not knowingly collect any Personal Information from a minor. If you learn that a child has, in violation of this Policy, provided their Personal Information, please report it to us for deletion. In the event that we learn that a child has provided us with Personal Information, we will delete it. Please see Section 10, “Children,” for more info.
OUR SERVICES AS IT RELATES TO CONSUMERS:
Valid Record provides its Services to our Clients and does not have a direct relationship with consumers, who are the end users of our Clients. Valid Record does not have control over the privacy policies of other websites or third parties that consumers may interact with, including those affiliated with our Clients. We strongly encourage consumers to carefully review all relevant terms and conditions, policies, and statements of the websites they visit in order to understand how their personal information is processed and to be aware of any rights they may have regarding the collection, use, and disclosure of their personal information.
CLIENT SERVICES AS IT RELATES TO CONSUMERS:
Our collection, processing, use, and storage of Consumer PII is dependent upon Clients implementing our Scripts and/or Services into their Platforms, which we do not control. Under our Terms and Conditions of Use, if our Clients use our Platform in connection with their collection and use of Consumer PII, they must comply with all applicable laws, including, where applicable, publishing and complying with an adequate privacy policy that discloses the use of our Platform and how our Platform collects and processes data, as described in our Terms and Conditions of Use and Privacy Policies. To the extent required by law, our Clients must provide detailed information about, and ensure Consumers consent to, the storing and accessing of cookies or other information on the Consumer’s device in connection with use of our Services on their website Platforms. Our Clients are not permitted to circumvent any opt-out options or other privacy features of our Platform; and are solely responsible for ensuring that they have permission from Consumers to use any Consumer PII in connection with their access and use of our Platform.
The data present within IClaim is considered the sole responsibility of the Clients, who own, direct, and action it. As such, we do not assume any responsibility for consumer requests or complaints related to the collection and retention of Personally Identifiable Information (PII).
ASSISTANCE FOR DATA SUBJECT RIGHTS:
While we are not engaged in direct consumer interactions or data collection on behalf of Clients, we offer assistance for applicable data subject rights related to IClaim data inquiries. Valid Record promptly responds to data subject requests and ensures timely research and fulfillment.
In the event of an individual contacting us regarding a data subject request, we follow specific procedures to locate relevant data. Once identified, we inform the Client notifying them of the request, The Client then takes appropriate actions to comply with the request, ensuring the necessary steps are taken to address the data subject's rights and concerns.

DATA ANALYSIS AND RESEARCH:
Valid Record retains the right to analyze and research aggregate or de-identified data for additional insights purposes for continual product functionality improvements, fraud detection, pattern recognition, data analytics and insights. Our purpose and use of data is not for any larger personal data or consumer profiling or advertising re-identification purposes.

We may combine Personal Data from multiple online and offline sources.

- Complying with Legal Obligations. Including complying with the law, our legal obligations, and legal process, such as warrants, subpoenas, court orders, and regulatory or law enforcement requests.
- Defending our Legal Rights. Including managing and responding to actual or potential legal disputes and claims, and otherwise establishing, defending, or protecting our rights or interests, including in the context of anticipated or actual litigation with third parties.
- When We Perform Our Duty in a Contract With You. We may use your Personal Information when you work as a service provider or apply for a job with us, as needed. If you are a consumer or a user of our Services, we will use your Personal Information to fulfill our duty in our agreement with you.
- To Assess and Accept Franchisees, Customers, or Vendors. This includes verifying the identity and credit status of some franchisees, customers, or vendors, conducting due diligence, and screening against publicly available government and/or sanctions lists and other third-party data sources, the use of and participation in the Company’s incident registers, and sector warning systems and/or third-party verification services. Collecting this Personal Information may involve a reference agency or other third parties.
- To Improve the Features, Products, and Services That We Offer Through the Sites. We may use Personal Information to improve our product offerings, Services, as well as our Sites and features.
5. Disclosure of Personal Data
We may share or disclose Personal Information with third parties to carry out business purposes. We may also share your Personal Information with third parties to whom you consent to us disclosing your Personal Information. Prior to sharing Personal Information with these third parties, we review the services performed by each third party and require that the third party keep such Personal Information confidential and secure and not use it for any purpose except performing the services.
We generally share Personal Information with third parties for the business and commercial purposes described below:
- With Our Partners, and Subsidiaries. We may disclose your Personal Information to our holding company, sister companies, and subsidiaries for the purposes described in the, “HOW WE USE YOUR INFORMATION,” section above. We also have relationships with various business and data partners that help us operate our business and for whom it may be required to have access to your Personal Information in the course of providing services. We require them to handle your Personal Information collected through the relationships in accordance with appropriate contractual privacy and security provisions.
- With Our Service Providers. We may disclose Personal Information to unaffiliated companies or individuals we hire or work with that perform services on our behalf, including customer support, web hosting, information technology, payment processing, financing, product fulfillment, fraud control, database management, and analytics services. These service providers have access to Personal Information needed to perform their services but may not use it for other purposes.
- In Connection with a Corporate Transaction. Personal Information may be disclosed or transferred as part of, or during negotiations of any purchase, sale, lease, merger, amalgamation, or any other type of acquisition, disposal, securitization, or financing.
- With Our Professional Advisors. We may disclose Personal Information to our legal, financial, insurance, and other advisors in connection with the kinds of corporate transactions described above or in connection with the management of all or part of Valid Record’s business or operations.
- With Law Enforcement Authorities and Individuals Involved in Legal Proceedings. We disclose Personal Information when we believe doing so is reasonably necessary to comply with applicable law or legal process (including an enforceable request from authorities), to respond to claims, enforce or apply our TERMS AND CONDITIONS OF USE, or to protect the rights, property, or personal safety of Valid Record, our users, employees, or others.
- With Your Consent or at Your Direction. We disclose Personal Information such as profile data and communications data to third parties when we have your consent or direction to do so.
- Aggregated, Anonymized or De-identified Data. We may also disclose aggregated, anonymized, or de-identified information, which cannot reasonably be used to identify you. Valid Record processes, maintains, and uses this data only in a de-identified fashion and will not attempt to re-identify such data, except as permitted by law.
A cookie is a small piece of data sent from the Sites and stored in a user’s web browser while the user is browsing Sites (“Cookie”). Every time the user loads Sites, the browser sends the Cookie back to the server to notify the Sites of the user’s previous activity. Web beacons (also known as image tags, gifs, or web bugs) are small pieces of code used to collect advertising data, such as counting page views, promotion views, or advertising responses (“Web Beacons”). We also may utilize pixels in connection with our email communications and in connection with the Sites. Our Sites’ web servers automatically collect and may use your Cookies, Web Beacons, pixels, and other similar tracking technologies (collectively “Tracking Technologies”) to collect information as you browse our Sites. We use Tracking Technologies, web server log files and tracking code, and information we receive through the use of these Tracking Technologies to analyze trends, administer the Sites, track users’ movement, and gather broad demographic information for aggregate use. Information of this type may be combined with other sources of information for these purposes.
Some of these Tracking Technologies may be placed by third-party service providers to help determine the effectiveness of our advertising campaigns or email communications. These Tracking Technologies may be used by these service providers to place a persistent Cookie on your computer. Doing this allows the service provider to recognize your computer each time you visit certain pages or emails and compile anonymous information in relation to those page views. The use of Tracking Technologies by third-party service providers is within their control and not ours. Additionally, you have choices about how certain third parties and advertisers use your information, including how we use and share your information for advertising and marketing purposes. Residents of certain states (such as California, Colorado, Connecticut, Utah, and Virginia) are afforded additional privacy rights by applicable law. We comply with all state and federal laws and you can learn more about those rights and choices in the “NOTICE TO RESIDENTS OF COLORADO, CONNECTICUT, UTAH, OR VIRGINIA,” section below.
7.1 Right to Non-Discrimination. Applicable law prohibits unreasonable adverse treatment or retaliation of individuals for exercising their rights.
8. Data Retention
We will retain your information for as long as needed to provide you with products and Services, and to comply with our accounting and legal obligations, resolve disputes, and enforce our agreements. Your Personal Information will be destroyed or permanently deleted as required by applicable law.
9. Security
Valid Record uses reasonable technical, physical, and administrative security measures to reduce the risk of loss, misuse, unauthorized access, disclosure, or modification of your information. Unfortunately, no transmission of data over the Internet is guaranteed to be completely secure. While we strive to protect your Personal Information, we cannot ensure or warrant the security or confidentiality of any Personal Information you transmit to us.
10. Children
We do not knowingly collect, use, share, or sell the Personal Information of individuals under the age of 16 and this Site is not directed to individuals under 16. If you become aware that an individual under 16 has provided us with Personal Information, please contact us through the methods provided in the, “CONTACT US,” section below or by visiting our “Contact Us” form. If we are made aware that we have collected Personal Information from an individual under the age of 16, we will delete this information as soon as practicable.
11. Other Websites
This Site may contain links to third-party websites that we do not own or operate. We are not responsible for the content or practices of such websites, including their practices with respect to your data. We have no responsibility or liability for such practices, and the website owner’s privacy policy governs your use of those websites. 12. Changes to this Privacy Policy
We reserve the right to modify or amend this Policy at any time and for any reason. Changes to this Policy shall be effective when posted to the Sites. In case of any material change to the Policy, we will notify you by providing a prominent notice on the Sites or by using the contact information you have on file with us. We will also revise the “Updated” date at the top of this Policy. You are responsible for reviewing this Policy each time you use or access the Sites. Your continued use of the Sites is an acknowledgment and consent to any terms contained in this Policy, as it may be amended from time to time. 13. Notice to California Consumers
If you are a California resident, California law requires us to disclose the following additional information with respect to our collection, use, and disclosure of Personal Data. If you are a California resident, this section applies to you. The purpose of this Notice is to provide you with our practices regarding the collection, use, and disclosure of your Personally Identifiable Information (“PII”) pursuant to the CCPA/CPRA and related initiatives.

We receive information from our Clients, visitors to our websites, and from websites using our Valid Record Services that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device.
Specifically, over the last twelve (12) months, we have received the following categories of personal information from our clients and website operators who have implemented any of the Valid Record Services:
13.2 Categories of info Valid Record May Have Collected. Valid Record may have collected the following categories of Personal Info: (i) identifiers, such as a name, email address, telephone number, postal address, unique personal identifier, online identifier, IP address, account name, Social Security number, driver’s license number; (ii) personal identifiers under Cal. Civ. Code § 1798.80(e), such as education, employment status, bank account information, financial information, medical information; (iii) protected classification characteristics under California or federal law, such as age, marital status, medical condition, gender, veteran or military status; (iv) commercial information, such as products or services obtained or considered, or other purchasing or consuming histories or tendencies; (v) Internet or other electronic network activity, such as browsing history and search history information; (vi) geolocation data; (vii) professional or employment-related history, such as consumer-reported current or past job history; (viii) inferences drawn from some of the information above (e.g., email open rates and time); and (ix) sensitive Personal Information, such as Social Security number, driver’s license number, and medical information.
13.3 Sources of Data Valid Record Collects. Valid Record collects Personal Information from various sources, including directly from You, the consumer, who visits or engages with our Sites, in addition to the following categories outlined below.
Partners and Third Parties: Consumers who visit websites our Clients or Partners own may be redirected to our Sites. In some cases, we may gather data directly from our Clients’ or Partners’ websites or other third parties may post data to our Sites or otherwise transfer data to us.
Service Providers: Valid Record engages service providers to perform a variety of functions.
Authorization: We require all parties from whom we receive Personal Information, whether they are Clients, Partners, service providers, or other third parties, to represent and warrant to us that they have appropriately obtained the Personal Information provided to us and have the authority to share the Personal Information with us.
13.4 Sources of Data iClaim Collects. iClaim, through its Clients, collects Personal Information from various sources, such as the JavaScript snippet utilized by a website operator on the selected websites. iClaim, nor Valid Record operate or control the websites in which iClaim is implemented on. You must review and understand the Clients’ relevant sites' privacy policies to determine what specific information or data is being collected.
13.5 Purposes for Which Personal Information is Collected and Used. See Section 1, “Privacy Policy” and Section 4, “How We Use Your Information” for a more detailed overview.
13.6 Categories of Third Parties with Whom Valid Record Has Disclosed Personal Information for a Business Purpose. In the Preceding 12 Months. In addition to sharing data for the primary use described in our Privacy Policy, we may share identifiers and internet activity (e.g., name, email address, telephone number, browsing history) with Clients, service providers, and Third-Party websites for business purposes only.
Additionally, Valid Record may disclose Personal Information and Third-Party data (e.g., identifiers, personal identifiers, protected classification information, geolocation data, and inferences) with service providers who assist us in compliance and verification activities, or provide services, such as payment processing, IT, and data analysis information.
13.7 Categories of Personal Information Sold or Shared. Under California law, some uses of Cookies and similar Tracking Technologies may be characterized as “selling” or “sharing” Personal Information. Because we use such Tracking Technologies, in the preceding 12 months we may have “sold” or “shared” the following categories of Personal Information for commercial purposes, such as to serve advertisements, to analyze the success of marketing campaigns, or to understand the use of our Websites, and such receiving entities may use the Personal Information for their own purposes, such as to improve their ability to target advertisements. As described above in Section 5, ”Disclosure of Personal Data,” Valid Record may disclose or sell Personal Information and Third-Party data, including identifiers, internet activity, personal identifiers, and protected classification characteristics (e.g., name, email address, telephone number, browsing history, education, inferences, browsing history, geolocation data) to analyze the success of marketing campaigns, or to understand the use of our Websites, and such receiving entities may use the Personal Information for their own purposes, such as to improve their ability to target advertisements.
13.8 Retention of Personal Information. We retain Personal Information only for so long as reasonably needed to fulfill the purposes for which we collected or obtained it. We use reasonable business criteria to establish retention periods for Personal Information. For example, if you register on our Sites, we will store your Personal Information for as long as needed to maintain your account, fulfill your requests, enforce any applicable terms that govern your use of the Sites, maintain appropriate records of the above, or as otherwise required by law.
14. Your California Privacy Rights
The California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) grant specific rights to consumers who are California residents concerning their Personal Information. This section outlines your CCPA/CPRA rights and provides guidance on how to exercise them. Please note that any Personal Information shared with us by a Client or through a site implementing IClaim is exclusively utilized to provide Services to that particular Client or site. We prioritize the privacy and security of your data and ensure its appropriate usage as stated in our policies. Under the CCPA/CPRA, a California resident has Privacy Rights that enable each resident a:
14.1 Right to Know and Access Your Personal Information. Under the CCPA/CPRA, you have the right to request that we provide you with information regarding what Personal Information about you we have collected, used, disclosed, shared, or sold in the preceding twelve (12) months. Once we receive your request and verify your identity, we will disclose to you one or more of the following as requested: The categories of Personal Information we have collected about you in the preceding twelve (12) months; The categories of sources from which we collected your Personal Information in the preceding twelve (12) months; The business or commercial purposes for collecting your Personal Information in the preceding twelve (12) months; The categories of third parties to whom we disclosed your Personal Information in the preceding twelve (12) months; and The specific pieces of Personal Information we collected about you in the preceding twelve (12) months.

14.2 Right to Delete Your Personal Information. Under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), you have the right to request that we transfer your Personal Information to another company or organization. Data portability allows consumers to request and obtain their Personal Information that a business has collected in a portable and easily usable format.
You have a right to request the deletion of your Personal Information that we have collected or have maintained in the past 12 months. However, this right to deletion does not apply to any of your Personal Information that is subject to an exception under the CCPA/CPRA. Once we receive your request and verify your identity, we will delete (and direct our contractors and service providers to delete) your Personal Information in our records that is not subject to any of the CCPA/CPRA exceptions.

14.4 Right to Opt-Out of the Sale or Sharing of Personal Information. You have the right to opt out of the “sale” or “sharing” of your Personal Information to a third party for cross-context behavioral advertising, as those terms are defined by applicable California law. 14.8 Response Time. We are committed to promptly addressing verifiable consumer requests in compliance with the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA).
